1. Seller

Hayim BOUHNIK — sole trader (entreprise individuelle)
Trading as: Hervé Bouhnik, painter
SIREN 882 566 037 — SIRET 882 566 037 00033 — business code 9003B
Email : contact@hervebouhnik.com
VAT not applicable, Article 293 B of the French General Tax Code.

2. Works

Every work offered is an original, one of a kind, sold unframed unless stated otherwise. Dimensions are given in centimetres, height × width. Photographs and on-screen colours are as faithful as possible but remain an approximation.

Certificate of authenticity. Every work sold comes with a certificate of authenticity signed by the artist, attesting that it is original and unique.

Each work being unique, its sale withdraws it from the catalogue immediately.

3. Prices

Prices are in euros, all taxes included. VAT is not applicable under Article 293 B of the French General Tax Code, so no VAT is charged or recoverable. Shipping costs, when they apply, are shown before the order is confirmed.

4. Order and payment

The order is final once payment is confirmed. Payment is made online, in a single instalment, by card through the secure Stripe platform. Card details are transmitted encrypted and are never stored by the seller. A confirmation email summarising the order is sent to the address you provide.

Retention of title. The work remains the property of the seller until the price has been paid in full.

5. Delivery

Preparation. Each work travels in packaging built for it, made after the order is placed. Shipping usually takes place within seven to ten working days of payment. Should a longer time be needed for your work, you are told before you confirm the order.

Cost and destination. elsewhere, the shipping cost is given to you and accepted before any payment. Some destinations ship on quotation: the order is only confirmed once the amount is agreed.

Carriage and insurance. Works travel with a carrier specialised in fine art, tracked and handed over against signature, and are insured for their declared value while in transit. The method and the cover applying to your shipment are stated before the order.

On delivery. Risk passes to you on delivery. If the work arrives damaged, write a detailed reservation on the carrier’s delivery note at the moment of handover, photograph the packaging before opening it, and tell us within three days. ⚠ A reservation such as “subject to unpacking” carries no weight: it must describe the damage seen.

6. Right of withdrawal

You have fourteen days from the day you receive the work to withdraw, without giving any reason. Tell us by any clear statement — the model withdrawal form below may be used. Return the work in its original packaging within fourteen days of telling us; return shipping is at your expense. You are refunded within fourteen days of our receiving the work back, using the same means of payment.

Exception — works made to order. Under Article L221-28 of the French Consumer Code, there is no right of withdrawal for a work made to your own specifications or clearly personalised. Where that applies, it is stated on the work’s page and confirmed before the order.

7. Model withdrawal form

8. Legal guarantees

The seller is bound by the legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code) and by the guarantee against hidden defects (Articles 1641 and following of the Civil Code). Under the guarantee of conformity you have two years from delivery to act, and may choose between repair and replacement, subject to the cost conditions of Article L217-12. Under the guarantee against hidden defects you may claim within two years of discovering the defect.

These guarantees cover defects, not the natural ageing of materials, nor damage caused by unsuitable hanging, humidity or direct sunlight.

9. Personal data

See our privacy policy.

10. Disputes
